Please read these Terms & Conditions ("Terms") carefully before accessing or using the OAKENA REIKI THERAPY website (the "Website") or booking any services provided by ANDREW and LYNDA MACLAREN ("we," "us," or "our") through the Website, including Reiki treatments (collectively, the "Services"). By accessing or using the Website or the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or the Services.
1. Introduction
1.1 These Terms & Conditions ("Terms") govern your use of the OAKENA REIKI THERAPY website (the "Website") and any services provided by ANDREW and LYNDA MACLAREN ("we," "us," or "our") through the Website, including Reiki treatments (collectively, the "Services").
1.2 By accessing or using the Website or the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or the Services.
2. Premises Policy & Eligibility
2.1 You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Website and the Services. As Oakena Reiki Therapy operates from a private residence, we maintain an adult-only policy for the entire premises. Children (individuals under 18 years of age) are not permitted anywhere within our premises, including common areas and the treatment room. We are unable to provide childcare and cannot accommodate minors on site.
2.2 You are responsible for ensuring that your use of the Website and the Services complies with all applicable laws and regulations in your jurisdiction.
2.3 Should a client arrive for their appointment with a child (under 18 years of age), service will be refused in accordance with this Premises Policy, and the full cancellation fee (as outlined in Section 5.1.2 for standard treatments, or Section 5.1.1 for half/full-day treatments, whichever is applicable) will be charged.
3. Services
3.1 We offer Reiki treatments and other related services as described on the Website.
3.2 We reserve the right to modify, suspend, or discontinue any of the Services at any time without prior notice.
4. Bookings and Payments
4.1 All bookings for Reiki treatments must be made through the Website or as otherwise instructed by us.
4.2 Payment for Services must be made in advance as indicated on the Website. Your booking is not confirmed until full payment has been successfully processed.
4.3 We reserve the right to change the prices for our Services at any time.
4.4 Mileage Policy: For services requiring travel to your location, our standard service area is within a 12-mile radius of our premises at ST7 2ZW. If your location is beyond this 12-mile radius, a travel surcharge of 45p per mile will apply for the round trip (both to and from your location). Mileage will be calculated based on the shortest available driving distance. To book a service at a location beyond the 12-mile radius, you must contact us directly at support@oakena-reiki.com before booking. Bookings made online for locations outside the 12- mile radius without prior agreement may be subject to cancellation, and any associated cancellation fees (as per Section 5.1.2 for standard treatments, or Section 5.1.1 for half/full-day treatments, whichever is applicable) may apply. In such cases, we will notify you by email as soon as possible, and the applicable cancellation fees will be charged.
5. Cancellation and Rescheduling Policy
At Oakena Reiki Therapy, we understand that unforeseen circumstances may occasionally require you to change or cancel your appointment. To ensure fairness to all our clients and to respectfully manage our practitioners' time and availability, we kindly request adherence to this cancellation policy. Please note that full payment for all treatments is required at the time of booking to secure your appointment. This upfront payment reserves a dedicated time slot specifically for you, and late cancellations often mean we are unable to reallocate that slot, resulting in a loss of income and opportunity.
5.1. Client Cancellations:
5.1.1. Half-Day and Full-Day Treatment Bookings: For all half-day (e.g., 3-4 hours) and full-day (e.g., 6+ hours) Reiki treatment bookings, we require a minimum of 7 days (168 hours) notice for any cancellation or rescheduling. This extended notice period is vital as these longer sessions represent a substantial allocation of our practitioner's time, making it particularly challenging to rebook the slot for another client on short notice.

Cancellations with 7 days or more notice: You will receive a full refund of your upfront payment, or your payment can be transferred in full to a rescheduled booking, as per your preference.

Cancellations with less than 7 days but more than 48 hours notice: A cancellation fee equivalent 50% of the total treatment cost will be retained from your upfront payment, and the remaining balance will be refunded to you.

Cancellations with 48 hours or less notice, or "No-Shows": The full upfront payment for the half-day or full-day treatment will be retained. This reflects the significant lost opportunity to offer this extensive time slot to another client and cover the preparation costs associated with such bookings. No refund will be issued.
5.1.2. All Other Treatment Services:
For all other Reiki treatment services (e.g., 45 minute, 60 minute, 90 minute sessions), we require a minimum of 48 hours (2 days) notice for any cancellation or rescheduling. This notice period allows us a reasonable timeframe to potentially offer the appointment to another client.

Cancellations with 48 hours or more notice: You will receive a full refund of your upfront payment, or your payment can be transferred in full to a rescheduled booking.

Cancellations with less than 48 hours’ notice, or "No-Shows": The full upfront payment for the treatment will be retained. This accounts for the lost opportunity to rebook the session. No refund will be issued.
5.2. Provider Cancellations:
If we need to cancel or reschedule your appointment due to unforeseen circumstances (e.g., practitioner illness, emergency), we will notify you as soon as possible. You will then have the option to either reschedule your appointment at no extra cost, or receive a full refund of the payment made for the cancelled treatment. We will not be liable for any additional costs incurred by you (e.g., travel expenses) as a result of our cancellation.
5.3. General Information Regarding Cancellations:

How to Cancel/Reschedule: To cancel or reschedule your appointment, you must contact us as soon as possible via email: support@oakena-reiki.com. The notice period begins from the time we receive your notification.

Refund Processing: Refunds for eligible cancellations will be processed to the original payment method as soon as possible of the cancellation being confirmed.
6. Reiki Session Policies and Environment
6.1 Reiki sessions at Oakena Reiki Therapy are conducted strictly on a one-to-one basis to ensure a private, tranquil, and dedicated therapeutic experience for the client.
6.2 Clients may choose to have one adult chaperone (over 18 years of age) present during their session if they wish. If you intend to bring a chaperone, you must notify Oakena Reiki Therapy at the time of booking. The chaperone's presence will be limited to observing the session from a designated area, respecting your privacy and the therapeutic process. Apart from the client and any pre-notified adult chaperone, no other individuals are permitted in the treatment room or on our premises during a session.
6.3 No Waiting Area:
As our practice operates from a private residence, we do not have a dedicated waiting area. We kindly ask clients to arrive promptly at their scheduled appointment time.
7. Conduct and Right to Terminate Session (Client & Animal)
We are committed to providing a safe environment for our staff, clients, visitors, and all animals receiving our services. The welfare of animals and the safety of all individuals present are paramount. We reserve the right to cease any session immediately and/or refuse further services if any of the behavioural issues or risks detailed in the following subsections (7.1 for Clients, and 7.2 for Animals) are encountered, or if any behaviour or circumstance, in our judgement, presents an unacceptable risk to safety.
7.1. Client Conduct and Termination:
7.1.1 For the safety and well-being of both our clients and practitioners, and to maintain a professional and therapeutic environment, Oakena Reiki Therapy reserves the right to immediately terminate a session without refund if, in our professional judgement:
a) A client appears to be under the influence of alcohol or non-prescribed drugs.
b) A client behaves in a disruptive, abusive, aggressive, discriminatory, or otherwise inappropriate manner.
c) There is a serious risk of harm to the client, the practitioner, or others, including, but not limited to, physical assault or threat of physical assault, disclosures of serious self-harm with intent or harm to others. In such circumstances, the session will cease immediately, and the client will be required to leave the premises.
7.1.2 Depending on the nature of the behaviour or risk, we may, if deemed necessary and in accordance with our legal and ethical obligations, contact appropriate emergency services or authorities (e.g., police, ambulance, mental health crisis teams) to ensure the client's safety and well-being whilst on our premises, or the safety of others.
7.1.3 Full payment for the terminated session will be retained, and no refund will be issued in these circumstances.
7.2. Animal Behavioural Issues and Termination:
7.2.1. For Dogs: Definition of Aggression:
Aggressive behaviour in dogs includes, but isn't limited to: growling, snarling, snapping, lunging, biting (whether or not it makes contact or causes injury), mouthing that causes discomfort or fear, prolonged or intense barking directed at individuals, or any other action that, in our professional judgement, suggests an intent to cause harm, fear, or presents a significant risk to the safety of our staff, other animals, or members of the public. This also extends to behaviour that demonstrates the dog is "dangerously out of control" as defined by the Dangerous Dogs Act 1991 (e.g., causing a reasonable apprehension of injury).

Session Termination: If your dog exhibits any such behaviour during a session, the session will be terminated immediately. We'll take all necessary steps to ensure the safety of all parties, which may include safely securing the dog, requesting you to muzzle or contain your dog, or, in severe cases, contacting appropriate authorities if public safety is at immediate risk.

Future Services and Management: Following a terminated session due to aggressive behaviour:

We'll discuss the incident thoroughly with you.

The owner will be required to seek a veterinary check-up for their dog to rule out any underlying medical or pain-related causes for the aggressive behaviour before any future sessions can be considered. A veterinary report may be requested at the owner’s expense.

We may also mandate a professional behavioural assessment by a qualified veterinary behaviourist or certified dog behaviourist before considering any future sessions.

You may be required to implement specific management protocols (e.g., muzzle training, specific handling techniques) for any subsequent appointments.

We reserve the right to refuse future treatment sessions if we determine that the risk associated with your dog's behaviour can't be adequately mitigated, or if our staff can't safely or effectively provide treatment.

Owner Responsibility: You, as the owner, remain solely responsible for your dog's behaviour at all times and for any damage or injury caused by your dog to persons, property, or other animals. This includes, but isn't limited to, veterinary, medical, and legal fees. We strongly advise owners of dogs with known aggressive tendencies to seek professional behavioural advice and consider appropriate liability insurance.
7.2.2. For Equines:

Definition of Aggression: Aggressive or dangerous behaviour in equines includes, but isn't limited to: biting, kicking, striking, rearing, charging, barging, excessive spooking or bolting that puts handlers or others at risk, or any other action that, in our professional judgement, suggests an intent to cause harm, fear, or presents a significant risk to the safety of our staff, other animals, or members of the public. This also includes any behaviour that demonstrates the equine isn't safely manageable under the circumstances.

Session Termination: If your equine exhibits any such behaviour during a session, the session will be terminated immediately. Our primary concern will be to ensure the safety of our staff and the animal, which may involve safely containing or moving the equine to a secure area.

Future Services and Management: Following a terminated session due to aggressive or dangerous behaviour:

We'll discuss the incident thoroughly with you.

The owner will be required to seek a veterinary check-up for their equine to rule out any underlying medical or pain-related causes for the dangerous behaviour before any future sessions can be considered. A veterinary report may be requested at the owners expense.

We may also recommend or require a professional behavioural assessment by a qualified equine behaviourist before considering any future sessions at the owner’s expense.

You may be required to implement specific management protocols (e.g., specific restraint methods, sedatives prescribed by a vet) for any subsequent appointments.

We reserve the right to refuse future treatment sessions if we determine that the risk associated with your equine's behaviour can't be adequately mitigated, or if our staff can't safely or effectively provide treatment.

Owner Responsibility: You, as the owner, remain solely responsible for your equine's behaviour at all times and for any damage or injury caused by your equine to persons, property, or other animals. This includes, but isn't limited to, veterinary, medical, and legal fees. We strongly advise owners of equines with known aggressive or dangerous tendencies to seek professional behavioural advice and ensure they have appropriate public liability insurance.

8. Distant Reiki Services
We're pleased to offer distant Reiki sessions for animals, providing flexibility while maintaining our commitment to safety and well-being. These sessions do not require physical contact with the animal by the practitioner.

Delivery Methods for Distant Reiki: Distant Reiki can be conducted in two ways:

On-Premises Distant Reiki: Our practitioner is present on your premises (e.g., at a stable yard or your home), but the animal remains with a handler in a separate, safe area, or is contained, ensuring no direct physical interaction between the practitioner and the animal.

Off-Site Distant Reiki: Our practitioner conducts the Reiki session from a different location entirely, without being present on your premises.

Suitability for Distant Reiki: Distant Reiki is offered on the understanding that the animal is generally safe and stable in its environment. It's not a substitute for veterinary care, immediate medical attention, or in-person behavioural intervention for aggressive or dangerous animals.

Safety and Environment: Regardless of the delivery method, the client is responsible for ensuring that the animal is in a safe and secure environment during the distant Reiki session. This means:

The animal shouldn't be in a situation where it poses a risk to itself, other animals, or any person.

If the animal has a history of aggression, is highly anxious, or exhibits unpredictable behaviour, the client must ensure that all appropriate safety measures are in place (e.g., secure containment, muzzling if necessary and safe, exclusion from areas where others are present) to prevent any harm to the animal itself, others, or property during or immediately after the session.

Our practitioner reserves the right to cease or refuse future distant Reiki sessions if they receive information or have reason to believe that the animal's behaviour poses an unmitigated risk to anyone, or if the environment in which the animal is kept during or around the sessions becomes unsafe due to unaddressed behavioural issues, including for the animal itself, even remotely. This applies whether the practitioner is on-premises or off-site.

Client Responsibility and Communication:

The client must provide accurate and complete information about the animal's current health, behavioural history (including any aggressive tendencies), and the environment in which the distant Reiki will be sent.

The client agrees to communicate any immediate changes in the animal's condition or behaviour that might impact the safety or efficacy of the distant session.

We strongly advise that if an animal exhibits severe aggression or dangerous behaviour, a qualified professional (veterinarian, veterinary behaviourist, or certified animal behaviourist) be consulted prior to or in conjunction with distant Reiki, as it's a complementary therapy and not a primary solution for such issues.

No Guarantee of Outcome: While we strive to provide beneficial distant Reiki sessions, we can't guarantee specific outcomes or results. Reiki is a complementary therapy and individual responses vary.
9. Intellectual Property
9.1 All content on the Website, including but not limited to text, images, logos, and trademarks, is protected by copyright, trademark, and other intellectual property laws.
9.2 You may not use any content from the Website for any commercial purpose without our prior written consent.
10. Limitation of Liability
10.1 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or the Services.
10.2 We do not warrant that the Website or the Services will be error-free, uninterrupted, or secure.
10.3 We are not responsible for any loss or damage caused by viruses, hacking, or other security breaches.
10.4 These Terms and Conditions do not affect your statutory rights as a consumer.
11. Data Protection
11.1 We will collect and process your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
12. Governing Law
12.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales, irrespective of the location where the services are provided (e.g., at Oakena Reiki Therapy’s premises or the premises where the services are provided).
12.2 Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these Terms
13.1 We may update these Terms from time to time.
13.2 We will notify you of any material changes to these Terms by email to the address associated with your account and/or by prominent notice on the Website homepage.
13.3 Your continued use of the Website or the Services after any changes to these Terms
constitutes your acceptance of the revised Terms.
